What is Bankruptcy?
Chapter 13 : Reorganization
A Chapter 13 is a reorganization plan for consumers who have suffered a financial setback and need assistance in the repayment of their debts. Once the Bankruptcy Petition has been filed and Automatic Stay of Action is set forth which prohibits ceditors from taking action agains the Debtor or the Debtor's property. Accordingly, a creditor can not foreclose or repossess property once the case has been filed. The Debtor submits a repayment plan to the Court based on their ability to pay their debts over a three to five year time frame. Many debts such as credit cards and medical bills can be discharged without payment if the debtor can show that they cannot afford to pay those creditors. Payment are made to an appointed Trustee according to the terms of the Chapter 13 Plan who then disburses those funds to the creditors on a priority basis.
If you havenever filed a previous Bankruptcy then our office will allow you to pay any attorney fees as part of your Chapter 13 Plan. You pay no Attorney fees up front.
Chapter 7 : Liquidation
A Chapter 7 is a process to get a discharge of all debts. The debtor must show the court that they ae unable to repay a significant portion of their debt. There are no payments in a Chapter 7 Bankruptcy and the entire process is usully accomplished in as little as three to four months.
You can pick your own payment plan for a Chapter 7 Bankruptcy. Pay as much or as little as you like, whatever suits your budget. You're already under financial strain or you wouldn't be considering this option.
